Following a commencement order issued on 31 March 2026, there will be a new trade marks law (Trade Marks (Jersey) Law 2026) coming into effect in Jersey on 01 August 2026. An accompanying Trade Marks (Jersey) Order 2026 was issued on 02 April 2026 which assists with the administration of the new law and will also come into force on 01 August 2026.

The new law introduces fundamental changes to the trade mark system in Jersey. The old UK based registration system is being replaced by an independent registration system.

Key features of the new system are set out below:

  • Multi-class, based on the Nice Classification
  • Convention priority claims now possible
  • Provision for collective and certification marks
  • Applicants of domestic applications must have a 本物の intention to use the trade mark applied for and have an address for service in Jersey
  • Applications will be examined to form and on absolute grounds before being published
  • The burden will be on earlier rights holders to actively oppose any conflicting applications
  • The opposition period will be two months (extendable to three months) after the date of publication and unregistered rights (including, passing off) can be used as a basis for opposition
  • Six months grace period for renewals, with restoration also possible following removal from the Register

The new law provides for the examination, publication, opposition and protection of International Registrations. However, the means of protection will differ from the position under the old law. At present, International Registrations designating the UK are automatically protected in Jersey without any additional action required by trade mark owners, despite the fact that no record is kept locally by the Registry of such rights.

Jersey is currently seeking to extend the Madrid Protocol concerning the International Registration of marks to Jersey via the UK. Once ratified, holders of International Registrations will be able to extend protection to Jersey via the Madrid system and local Jersey businesses will also be able to take advantage of the International trade marks system.

The new system will bring some much needed clarity to existing trade mark rights covering Jersey, and the new provisions around examination, publication and opposition will ensure that new rights are more robust and reflective of the local market.

Existing registrations and marks protected via UK designation of International Registrations

All existing registered trade marks on the Jersey Trade Marks Register and UK designations of International Registrations which have already been granted protection in the UK will be automatically placed on the new Register on 01 August 2026.

A new IP Register

In addition to the changes discussed above, The Registrar of Intellectual Property (Jersey) Law 2026, which will also come into effect on 01 August 2026, will create a new IP Register for Jersey which will be administered by the Jersey Financial Services Commission.

Forms and fees for the new system are yet to be announced, but the changes are an important step forward for Jersey’s trade marks regime.
