We are pleased to confirm that Bermuda’s new Trade Marks Act 2023 has officially come into effect from 1 August 2025.

This marks a significant milestone in the reform of Bermuda’s intellectual property regime. The new legislation replaces the outdated 1974 Act and introduces a modernised framework that brings Bermuda into closer alignment with international best practices.

Key Features of the New Law

  • Multi-class applications are now permitted, simplifying the filing process and reducing costs.
  • The definition of a trade mark has been broadened to allow for non-traditional marks, such as sound marks and colour marks.
  • Provisions for international registrations under the Madrid Protocol and priority claims under the Paris Convention are in place, although Bermuda has not yet acceded to these treaties and there is no timeline as to when that will happen.
  • There are provisions for registering security interests and trade mark licences.
  • The new official fees are anticipated to be issued shortly.
