There is change on the way at the Trademark Office in Libya, thanks to the new Executive Regulations, no. 26 of 2024.

The implementation date

The Executive Regulations, no. 26 of 2024, were published on 17 January 2024, which is the official implementation date.

Here are some of the more important changes brought about by the Regulations:

The Nice Classification

Libya has adopted the 11th Edition of the Nice Classification.

Official fees

There has been a revision of the fee structure and a notable increase in the official fees.

Documents required

These have not been changed by the Regulations.

Publication and the Trademark Office

The Office has started to publish new applications, renewals and recordal changes electronically. However, we understand that the Office remains resource constrained and is facing considerable delays.

Opposition term

The opposition period has been cut down from 90 days to 30 days.

Sound trade marks

We understand audio trade marks are now available.

 

While these changes are substantial, their impact on stakeholders and the overall trade mark registration process remains to be seen.
