Following the coming into force of Zambia’s new Trade Marks Act No. 11 of 2023 on 31 December 2025, and our recent update, the Zambian Trade Marks Registry is now accepting and processing service mark applications in Zambia, notwithstanding that the new accompanying Regulations have not yet been formally published.
Service Mark Applications in Zambia: Filing requirements
In order to proceed we will require details of the services to be covered by the mark as well as the following documents:
- Power of attorney, simply signed.
- If Convention priority is claimed, a certified copy of the priority document, with verified English translation.
Currently, the fees remain unchanged as the Registry is relying on the previous Regulations, including forms and fees.
Multi-class applications
While the Trade Marks Act 2023 provides for the filing of multi-class applications, the Registry’s current guidance has been limited to the processing of service mark applications on a single-class basis.
Practical implications
This development presents an important opportunity for brand owners to secure service mark protection in Zambia under the new Act and, Rights holders should review their existing portfolios and filing strategies.
We will continue to monitor the position closely and will publish further updates as soon as additional guidance or the new Regulations become available. お問い合わせ for more information, or view more legal updates.
